Terms of Service

1. Acceptance of Terms

By downloading, installing, or using PICABOT software or any related services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms apply to all users, including businesses and individuals using PICABOT for commercial photo booth operations.

2. Description of Service

PICABOT is a professional Windows-based photo booth management software that enables businesses to operate automated photo booth experiences. The Service includes:

  • PICABOT desktop application for Windows 10/11
  • Cloud-based account management at picabot.club
  • API services for device licensing, transaction tracking, and subscription management
  • QR-based photo sharing service
  • Template management and customization tools

3. User Accounts

You must create an account to use PICABOT. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain the security of your password and auth token
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activities under your account
  • Not share your account credentials or auth token with unauthorized parties

Each account is limited to 1 registered device at a time. You may delink and re-register on a new device, but simultaneous multi-device use requires separate accounts.

4. Subscriptions and Plans

Free Plan

The Free plan provides access to core features including basic photo capture, local saving, basic templates, kiosk mode, and QR sharing with watermarks. The Free plan is provided at no cost for as long as we offer it.

Pro Plan

The Pro plan is a paid subscription that unlocks 4K camera support, watermark removal, live payment gateway integration, white-label customization, and commercial license. Pro is available as a monthly (₹1,800/month) or yearly (₹18,000/year) subscription.

Billing

  • Subscriptions are billed in advance and are non-transferable
  • Subscription fees are exclusive of applicable taxes
  • We reserve the right to change subscription pricing with 30 days notice

5. License Grant

Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Install and use PICABOT on one (1) registered device per account
  • Use the software for lawful commercial or personal photo booth operations
  • Access and use the web portal and API services associated with your account

This license does not include the right to sublicense, resell, or distribute the software to third parties.

6. Restrictions

You agree not to:

  • Reverse engineer, decompile, or disassemble the PICABOT software
  • Remove or alter any copyright, trademark, or proprietary notices
  • Use the Service to violate applicable laws or regulations
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Use automated tools to scrape, crawl, or access the Service in bulk
  • Circumvent device licensing restrictions or auth token validation
  • Resell access to the Service without prior written authorization

7. Photo Content and QR Sharing

When using the QR sharing feature:

  • Photos are uploaded to our servers temporarily for sharing purposes
  • Shared photos are automatically deleted after 24 hours
  • You retain all rights to photos captured using PICABOT
  • You are responsible for ensuring you have consent from any individuals photographed
  • You must not use the sharing feature to distribute illegal, harmful, or offensive content

PICABOT is not responsible for how your clients use or distribute shared photos.

8. Payment Processing

PICABOT integrates with Razorpay for payment processing. By using Razorpay integration, you agree to their terms of service. PICABOT:

  • Does not store your Razorpay API keys in plain text
  • Is not responsible for payment failures caused by Razorpay
  • Does not have access to your complete Razorpay account data

Refund Policy

PICABOT subscription fees are non-refundable except where required by applicable law. If you believe you were charged in error, contact us within 7 days at info@picabot.club.

9. Intellectual Property

PICABOT software, branding, documentation, and all associated intellectual property are owned by PICABOT and its licensors. These Terms do not grant you any rights to our trademarks, logos, or brand elements.

Templates you create using PICABOT remain your property. Default and bundled templates are provided for use with the software only and may not be extracted or used in other applications.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our data practices as described in the Privacy Policy.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We do not guarantee the accuracy of any information provided through the Service.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PICABOT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability to you for any claims arising from these Terms or the Service shall not exceed the amount paid by you in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless PICABOT and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you upload or process through the Service

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in India.

15. Modifications

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the date at the top of this page and by sending email notification where appropriate. Continued use of the Service after changes constitutes acceptance of the updated Terms.

16. Termination

We may suspend or terminate your account and access to the Service at our discretion if:

  • You violate these Terms
  • We reasonably suspect fraud or abuse
  • Your subscription payment is overdue by more than 14 days
  • We decide to discontinue the Service (with 30 days notice)
